AwoofHub Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the AwoofHub website, mobile application, and related services (collectively, the "Platform"), operated by AwoofHub ("AwoofHub," "we," "us," or "our").

By creating an account, browsing, posting, or claiming a deal on the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

2. Eligibility

You must be at least 18 years old to create an account or use the Platform. By using AwoofHub, you confirm that you meet this requirement and that all information you provide is accurate and current. If you are registering on behalf of a business, you confirm you have the authority to bind that business to these Terms.

3. What AwoofHub Is

AwoofHub is a deal discovery platform that allows users ("Awoofers") to post, browse, and claim deals, discounts, freebies, and promotional offers. Deals may be posted by individual Awoofers or by businesses and are reviewed by our team before appearing publicly on the Platform. AwoofHub is a discovery and listing platform. We are not a party to any transaction between an Awoofer and a business. We do not sell, fulfil, deliver, or guarantee any product or service featured in a deal.

4. Account Registration and Security

To access certain features, you must create an account with accurate information, including a valid phone number and/or email address. You are responsible for:

• Keeping your login credentials confidential.
• All activity that occurs under your account.
• Notifying us immediately at legal@awoofhub.ng if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts that provide false information, impersonate another person or business, or are used in violation of these Terms.

5. Posting Deals

Anyone posting a deal on AwoofHub — whether an individual Awoofer or a business — agrees that:

• The deal is real, current, and accurately described at the time of posting.
• You have the right to offer the deal, product, or service described.
• The deal is not fraudulent, misleading, or designed to collect personal data under false pretences.
• You will honour the deal as described for any Awoofer who claims it in good faith, within the stated validity period

All submitted deals go through a review process before publication. AwoofHub reserves the right to approve, reject, edit, suspend, or remove any deal at our sole discretion, including after it has already been published, if we determine it violates these Terms, our Community Guidelines, or applicable law. We are not obligated to explain every moderation decision in detail, though we will generally provide a reason for rejection where practical.

6. Claiming Deals

When you claim or "grab" a deal, you are entering into a direct interaction with the business or individual offering that deal — not with AwoofHub. We facilitate the discovery and connection, but:

• We do not guarantee that a deal will still be available, honoured, or in stock at the time of claim.
• We do not process payments, handle deliveries, or manage fulfilment for any deal.
• Any dispute regarding a deal's fulfilment is between you and the business or individual who posted it, though we encourage you to report issues to us so we can take appropriate action against bad actors.

7. Acceptable Use

You agree not to:

• Post fake, expired, duplicate, or misleading deals.
• Use the Platform to collect personal data from other users for unauthorised purposes.
• Harass, abuse, or impersonate other users.
• Post spam, malware, or unauthorised advertising outside the deal-posting features.
• Attempt to bypass, disable, or interfere with the Platform's review, security, or moderation systems.
• Use bots, scrapers, or automated tools to extract data from the Platform without our written permission.
• Use AwoofHub for any unlawful purpose or in violation of any applicable Nigerian law.

Violation of this section may result in content removal, account suspension, or permanent termination, at our discretion, in addition to any other legal remedies available to us. Full behavioural rules for the community are set out in our Community Guidelines, which form part of these Terms by reference.

8. Business and Merchant Terms

Businesses posting deals on AwoofHub additionally agree that:

• They are responsible for fulfilling every deal they post as described, for the full stated duration.
• AwoofHub may request reasonable verification of a business's identity or legitimacy before or after a deal is published.
• Repeated posting of inaccurate, expired, or misleading deals may result in suspension of posting privileges.
• Any advertising or promotional features offered by AwoofHub (including future paid features) are subject to additional terms provided at the time such features are introduced.

9. User Content and Intellectual Property

Your content: You retain ownership of any content you submit to AwoofHub (deal descriptions, images, comments). By posting content, you grant AwoofHub a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that content on the Platform and in related marketing, for as long as the content remains on the Platform or as reasonably needed for archival and legal purposes.

Our content: The AwoofHub name, logo, design, and underlying software are the property of AwoofHub and may not be copied, reproduced, or used without our written permission. You confirm that any content you post does not infringe the intellectual property or other rights of any third party.

10. WhatsApp Community

AwoofHub maintains a WhatsApp community for Awoofers. Participation is optional and subject to WhatsApp's own terms and privacy policy in addition to these Terms. AwoofHub reserves the right to remove members who violate our Community Guidelines within that space.

11. Disclaimers

The Platform and all deals listed on it are provided "as is" and "as available." To the fullest extent permitted by law, AwoofHub disclaims all warranties, express or implied, including but not limited to:

• That deals listed are error-free, always available, or fit for a particular purpose.
• That the Platform will be uninterrupted, timely, secure, or free of errors.
• That any business or individual posting a deal will honour it.

AwoofHub reviews deals before publication, but this review does not constitute a guarantee, endorsement, or warranty of any deal, product, service, or business.

12. Limitation of Liability

To the fullest extent permitted under Nigerian law, AwoofHub, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from:

• Your use of, or inability to use, the Platform.
• Any deal, product, or service obtained through a business or individual found on the Platform.
• Unauthorised access to or alteration of your data.
• Any conduct of a third party on the Platform

Where liability cannot be fully excluded under applicable law, AwoofHub's total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the equivalent of ₦50,000 (fifty thousand naira) or the amount you have paid us in the past twelve months, whichever is lower.

13. Indemnification

You agree to indemnify and hold AwoofHub harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your posted content, or your interactions with other users or businesses on the Platform.

14. Termination

You may stop using the Platform and delete your account at any time. We may suspend or terminate your access to the Platform, with or without notice, if we reasonably believe you have violated these Terms, our Community Guidelines, or applicable law, or if we are required to do so by law. Sections of these Terms that by their nature should survive termination (including Sections 9, 11, 12, and 13) will continue to apply after your account is closed.

15. Changes to the Platform and These Terms

We may modify, suspend, or discontinue any part of the Platform at any time. We may also update these Terms from time to time; material changes will be communicated via the Platform or by email, with an updated "Last Updated" date above. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms or your use of the Platform shall first be attempted to be resolved informally by contacting legal@awoofhub.ng. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

17. General

• Severability: If any part of these Terms is found unenforceable, the remaining provisions remain in full effect.
• No waiver: Our failure to enforce any part of these Terms does not waive our right to do so later.
• Entire agreement: These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and AwoofHub regarding the Platform.
